General Provisions

This Privacy Policy is directed to Buyers and other users of the online store located at activeshop.com.pl and syis.pl.

The policy defines the principles of collecting and processing personal data obtained by the Administrator both during the registration of an account in the online store, using the service, as well as when making purchases without creating an account and when subscribing to the newsletter.

Legal Basis and Purpose of Personal Data Processing

Your personal data is processed in accordance with the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter referred to as GDPR).

Your personal data is processed in connection with:

  1. the necessity of performing contracts concluded by you with the Administrator, as well as actions taken before the conclusion of the said contracts at your request (Art. 6(1)(b) GDPR),
  2. the necessity of fulfilling a legal obligation imposed on the Administrator (Art. 6(1)(c) GDPR),
  3. your consent to the processing of personal data for marketing purposes, including sending commercial information (Art. 6(1)(a) GDPR),
  4. the legitimate interests of the Administrator in marketing its own products and services, as well as in securing and pursuing claims (Art. 6(1)(f) GDPR).

Providing your personal data based on points 1) and 3) above is voluntary, but the refusal to provide data will prevent you from concluding a contract with the Administrator or using the Store and services provided electronically by the Administrator.

Users can withdraw their previously given consent to the processing of personal data for one or more purposes at any time.

Sharing Personal Data

Your personal data will be disclosed to competent state authorities or third parties if such obligation arises from generally applicable law.

The Administrator also provides your personal data to a selected carrier or intermediary handling shipments on behalf of the Administrator for the purpose of delivery, as well as to entities providing electronic payment services or credit institutions providing credit for the purchase of goods or leasing, entities providing hosting/server services, and entities from the IT industry maintaining the online store, entities providing legal services, and entities responsible for debt collection.

The Administrator protects your personal data in accordance with applicable regulations and the highest security and data protection standards.

The Administrator ensures the security of personal data through the implementation of appropriate technical and organizational measures aimed at preventing unlawful processing of data, as well as their accidental loss, destruction, or damage. The Administrator takes all possible measures to ensure that personal data is:

  1. correct and processed lawfully,
  2. obtained only for specific purposes and not processed further in a manner incompatible with those purposes,
  3. adequate, relevant, and not excessive,
  4. accurate and up-to-date,
  5. not stored for longer than necessary,
  6. processed in accordance with the rights of the data subjects, including the right to restrict disclosure,
  7. safely stored,
  8. not transferred without adequate protection.

Personal data collections are protected against access by third parties. Only persons authorized by the Administrator, trained in the protection of personal data, and obliged to keep your personal data confidential, are allowed to process your personal data.

Retention Period of Personal Data

Your personal data is processed for the period:

  1. necessary to secure or pursue any claims arising from the contract,
  2. post-sales contract service (handling complaints),
  3. fulfillment of a legal obligation imposed on the Administrator (resulting, for example, from accounting and tax regulations),
  4. until objection is made, in the event that personal data is processed for marketing purposes based on the legitimate interest of the Administrator,
  5. until consent is withdrawn, if the processing is based on consent previously given, without affecting the legality of the processing carried out on the basis of consent before its withdrawal.

Rights of Data Subjects

You have the right to request access to personal data, their correction, deletion, or limitation of processing, data portability, and to object to processing. You can also withdraw your previously given consent to the processing of personal data at any time.

Right to Access Data

At any time, you can request information about which of your personal data is being processed. You have the right to obtain from the Administrator the following information:

  1. the purpose, scope, and method of processing your personal data,
  2. since when your data has been processed,
  3. the source from which your data originates,
  4. recipients or categories of recipients to whom the data is disclosed.

Right to Amend, Update, and Delete Data

Upon your request, the Administrator will supplement, update, and correct your personal data, as well as temporarily or permanently suspend their processing or delete them if your data turns out to be incomplete, outdated, untrue, or has been collected in violation of the law or is no longer necessary for the purpose for which it was collected.

Right to Object

If the Administrator processes your data for direct marketing purposes, including profiling, you have the right to object to the processing of your personal data for such marketing at any time. To exercise this right, please submit a relevant request to the email address.

Right to Lodge a Complaint

You have the right to lodge a complaint with the supervisory authority if you believe that the processing of personal data violates the provisions of the GDPR.

Change of Personal Data and Updating

If your personal data changes, please update it in your user account, if created, or notify the Administrator by telephone, in writing to the company's registered office, or by email.

Right to Withdraw Consent

You have the right to withdraw your previously given consent to the processing of personal data at any time.

Administrator's Use of Cookies

In connection with providing content on the website, the Administrator uses so-called cookies, i.e., information stored by servers on the end user's device, which servers can read each time they connect to that end device. Servers may also use other technologies with functions similar to or identical with cookies (information about cookies also applies to other similar technologies used within our website). Cookies are computer data, especially text files, which are stored in the end user's device of the activeshop.com.pl website. Cookies typically contain the name of the website's domain from which they come, the time of their storage on the end user's device, and a unique number.

Purpose of Using Cookies

Cookies used by the Administrator are used for:

  1. adapting the content of the website to the user's preferences and optimizing the use of websites; in particular, these files allow for recognizing the user's device of the website user and displaying the website in a way tailored to their individual needs,
  2. creating statistics that help understand how website users use websites, which allows improving their structure and content,
  3. maintaining the user's session of the online store (after logging in), thanks to which the user does not have to re-enter their login and password on each subpage of the website,
  4. delivering users advertising content more tailored to their interests.

The Administrator may use the following types of cookies on the online store's website:

  1. "necessary" cookies, enabling the use of services available within the website, e.g., authenticating cookies used for services requiring authentication within the website,

Changing Cookie Settings

In many cases, the software used for browsing websites (web browser) allows cookies to be stored on the end user's device by default. Users of the store can change their cookie settings at any time. These settings can be changed, in particular, in such a way as to block the automatic handling of cookies in the web browser settings or to inform about their every placement in the user's device of the website. Failure to change the cookie settings means that they will be placed in the user's end device, and thus, we will store information in the user's end device and access this information.

However, disabling the option of accepting cookies does not mean the inability to read or watch the content posted in the online store, except for those to which access requires logging in.

Collection of Other Data

Like most online stores, we collect information about how users use the online store and their IP addresses based on access logs analysis. This information is used for technical purposes related to server administration of our website and for statistical purposes, including demographic analysis of users. In accordance with Article 18(6) of the Act of 18 July 2002 on the provision of electronic services and other applicable legal provisions, we may be obliged to provide information, including in particular the IP address of the computer, contained in access logs at the request of authorities authorized by law for the purposes of proceedings conducted by them.
